TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement (the "Agreement") is made and entered into between Makeup by Holly, LLC, doing business as Makeup by Holly Beauty Partners ("Makeup by Holly"), with its principal place of business located at 11404 Hunton Ridge Lane, Glen Allen, VA, 23059, and the customer ("Customer") who agrees to the terms and conditions set forth below, collectively referred to as the "Parties".

1. SERVICES

Makeup by Holly offers cosmetic and beauty services to the Customer, including but not limited to makeup application, beauty consultations, and related services (the "Services"). The details and scope of the Services will be agreed upon separately between Makeup by Holly and the Customer.

2. PAYMENT

Customer agrees to pay Makeup by Holly the agreed-upon fees for the Services rendered. Payment terms, including the amount, method of payment, and any applicable cancellation or refund policies, will be specified in writing or discussed with the Customer prior to providing the Services.

3. APPOINTMENTS

Customer agrees to schedule appointments for the Services in advance and arrive promptly at the agreed-upon time. Makeup by Holly reserves the right to reschedule or cancel appointments as necessary due to unforeseen circumstances.

4. CUSTOMER RESPONSIBILITIES

Customer warrants and represents that they are in good health and will provide accurate information about any medical conditions or allergies relevant to the Services. Customer agrees to follow the recommendations and instructions provided by Makeup by Holly to ensure the best possible results.

5. LIABILITY

Makeup by Holly will make reasonable efforts to provide high-quality Services, given the nature of the industry. However, Makeup by Holly shall not be responsible for any adverse reactions, injuries, or damages that may occur as a result of the Services or any products used during the provision of the Services.

6. CONFIDENTIALITY AND USE OF CONTENT

Any sensitive or personal information shared by the Customer with Makeup by Holly will be treated as confidential and will only be used for the purpose of providing the Services. Makeup by Holly may request and use photographs or videos of the Services for promotional purposes unless otherwise agreed upon with the Customer.

7. INTELLECTUAL PROPERTY

Makeup by Holly retains all rights, title, and interest in any intellectual property developed or created by Makeup by Holly during the provision of the Services, including but not limited to any customized makeup looks or techniques. Customer agrees not to reproduce or distribute any such intellectual property without prior written consent from Makeup by Holly.

8. TERMINATION

Either party may terminate this Agreement upon written notice to the other party. Upon termination, any outstanding amounts owed to Makeup by Holly shall become immediately due and payable.

9. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties concerning the subject matter hereof and supersedes all prior or contemporaneous written or oral agreements.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Virginia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Virginia.
